Why Do You Need an Asylum Lawyer?

  • Asylum Seekers Facing Persecution – If you or your family have credible fear of returning to your home country due to persecution because of your race, religion, nationality, political opinion, or membership in a particular social group, a lawyer could be your greatest ally in the asylum process.

  • Individuals in Immigration Detention or Facing Removal Proceedings – Immigrants currently held in detention centers or fighting deportation cases have critical and urgent needs for expert legal representation.

    What is Credible Fear?

Having credible fear means that you firmly believe that you or your family will be persecuted or tortured in your home country. Before determining the validity of your application, you will be invited to an interview for a credible fear screening. An asylum officer from U.S. Citizenship and Immigration Services (USCIS) will determine if you have a credible fear and if you are likely to be persecuted in your home country.

This does not grant you asylum but instead allow you to pursue your asylum case.

    Types of Asylum Cases

It’s important to understand that not all asylum cases are the same. Your asylum lawyer will guide you through one of two primary pathways, depending on your circumstances.

Consult an Asylum Lawyer for Affirmative Asylum

The affirmative asylum process is for individuals applying directly to USCIS. This is for applicants who have not yet faced removal proceedings. Within 14 days of applying, USCIS will issue you a date to attend an interview and biometrics based on their availability.

Consult an Asylum Lawyer for Defensive Asylum

Defensive asylum is sought in immigration court during removal proceedings. This option applies when the Department of Homeland Security (DHS) aims to deport an individual, and being denied asylum can result in removal. An asylum lawyer will represent you during deportation hearings and build a strong case to prove your eligibility under asylum laws.

    Asylum Eligibility Requirements

Before applying for asylum, you must meet specific eligibility requirements:

      • Credible Fear of Persecution – You must demonstrate that you could face persecution in your home country.
      • Protected Grounds – Your fear of persecution must be based on at least one of these five grounds:
        • Race
        • Religion
        • Nationality
        • Political opinion
        • Membership in a particular social group

      • Timely Filing – You must apply for asylum within one year of arriving in the United States unless extraordinary circumstances justify a delayed filing.

An asylum lawyer can review your case and determine if you meet the necessary eligibility requirements.

      Bars to Asylum

Some individuals can be barred from applying for asylum if they:

      • Participated in persecuting someone else due to their race, nationality, religion, political beliefs, or membership in a social group
      • Were convicted of a serious crime
      • Committed a non-political but serious crime outside the U.S.
      • Are a threat to national security in the United States
      • Lawfully lived in another nation before coming to the U.S. and can safely return there instead of their home country.

Can an Asylum Lawyer Help You Apply for a Green Card?

If USCIS approves your asylum application, you must maintain your asylum status for one year. Then, an asylum lawyer can help you apply for adjustment of status to get a green card (lawful permanent residency).

After 5 years of lawful permanent residency, your asylum lawyer can even help you apply for U.S. citizenship.
